Terms of Service

These Terms and Conditions ("Terms") govern your use of the Fixspire platform ("Fixspire" or the "Platform") developed and owned by IHSUK TECH PRIVATE LIMITED ("we", "us", "our"). By accessing or using Fixspire, you accept and agree to be bound by these Terms. If you do not agree, do not use the Platform.

These Terms are in full compliance with applicable Indian laws and regulations, including but not limited to:

• The Indian Contract Act, 1872
• The Information Technology Act, 2000 and its SPDI Rules, 2011
• The Indian Penal Code, 1860 (where applicable)
• The Consumer Protection Act, 2019
• The Digital Personal Data Protection Act, 2023 (upon notification)
• The Goods and Services Tax Act, 2017

Users agree to comply with all relevant national, state, and local laws in their use of the Platform.

To use Fixspire, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding contract
• Use the Platform in accordance with all applicable laws and regulations

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Fixspire in accordance with these Terms for your internal business purposes.

• You must register an account to use certain features.
• You are responsible for maintaining the confidentiality of login credentials.
• You agree to provide accurate and complete information.
• You are solely responsible for all activity under your account.

• All rights, title, and interest in Fixspire, including source code, UI, brand elements, and documentation, remain the property of IHSUK TECH PRIVATE LIMITED.
• Users retain ownership of their uploaded content but grant Fixspire a license to process and use such content for service delivery.

You agree not to:

• Copy, reverse engineer, or decompile Fixspire
• Use the platform for unauthorized or unlawful purposes
• Transmit viruses, malware, or malicious code
• Interfere with or disrupt the Platform's operation
• Access or use the Platform to build a competing service

• Some services may require a paid subscription.
• Pricing, billing frequency, and cancellation terms are disclosed at the time of purchase.
• All payments are processed securely via authorized gateways (e.g., Razorpay, Stripe).
• All payments are subject to applicable taxes, including GST, as per the laws of India.

• We may suspend or terminate your access for breach of these Terms or applicable laws.
• Upon termination, your license will be revoked, and access to services and data may be restricted.
• You may cancel your account at any time via written request.

Our handling of your personal data is governed by our Privacy Policy. Continued use of Fixspire indicates your acceptance of those terms.

• Fixspire is provided on an "AS IS" and "AS AVAILABLE" basis.
• We do not guarantee uninterrupted or error-free operation.
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability for claims arising from the use of Fixspire will not exceed the amount paid by you in the last 12 months.

You agree to indemnify and hold harmless IHSUK TECH PRIVATE LIMITED, its officers, directors, and affiliates from any claims, damages, or liabilities arising from your use of Fixspire, your content, or your violation of these Terms.

We may revise these Terms at any time. Changes will be communicated via email or in-app notification. Continued use of the Platform after changes constitutes acceptance.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.
